A spouse cannot be disinherited, so if the trust tries to disinherit the spouse that spouse can claim the "spousal elective share" which is 1/3 of the "augmented estate." A lawyer who practices in this area can help you determine what every heirs true rights are.

It is a crime to fail to file a will for probate. I couldn't guess what any particular attorney would charge. You should hire an attorney in the county where the mother resided at the time of her death.

A will in Ohio does not have to be notarized. Instead, it needs to be witnessed by two individuals who sign the will in the presence of the person creating the will and in the presence of each other. If this is done, the will is valid. Note: This is not true for all states.
