Does property go to probate if it’s already in my name or just the other items stated in the will?

Answered by attorney Sabina Tomshinsky
Estate Planning lawyer at Home Town Law, P.A.
No, you do not have to do anything with property that is already in your name; you usually open a probate action to transfer property per the will or intestacy laws that is held in the decedent's name. Also, please be aware that the power of attorney expires upon the death of the principal.

What is the average cost?

Answered by attorney Terry Lynn Garrett
Estate Planning lawyer at The Garrett Law Firm, PLLC
You must choose your own executor.  If you know of no person you would name, contact a trust company or a bank with trust powers to ask how much they would charge. Unless you have a large estate, it is probably not worth their while.

Do I have to pay gift taxes?

Answered by attorney David Goldman
Estate Planning lawyer at Law Office of David M. Goldman PLLC
Gift taxes are paid by the person making the gift, not receiving it. Unfortunately if the home was given to you while your parents were alive, your cost will be $0 so when you sell it you will pay much more in taxes than if you had received it upon death.
