If the property is only held in your father's name and be is deceased, it must go through probate. The probate Court will then issue an order transferring title or an Executor's or Administrator's deed is signed by the personal representative once the same is ordered by the court.

In Florida there is no inheritance tax. I don't know what work the lawyer did or how much is involved. However, probate courts have to right to review attorney fees and if the judge thinks it is too high, he can make the lawyer give some of it back. Lawyers may not charge an excessive fee- it's in our Bar rules.
