In order to settle an estate valued under 150,000 without probate does the real property have to be less than 50,000?

This is apparently not a Michigan matter. You should repost in the state involved. In Michigan, any estate in excess of $21k has to go through some form of probate. We also do not use Deeds of Trust

You need to request a duplicate title from the Missouri Department of Revenue. In order to transfer the title after you get it you must open an estate in the probate Division of the circuit court in the county where your mother was living when she died. You will either have to have a full administration or some form of abbreviated procedure. You need to retain a Missouri attorney to help you with this.

You should consult with an estate planning attorney on preparing a new deed where you would own (what I assume a homestead) property together with your husband. Otherwise, you will have a life estate in the home that can be converted to a tenancy in common and unless converted to such a tenancy in common, upon your passing, the home will revert back to your husband's children.
