Would judges follow a signed will over one that was not?

Vincent A. Liberti
Answered by attorney Vincent A. Liberti (Unclaimed Profile)
Estate Planning lawyer at Halloran & Sage LLP
Only an original, properly executed (signed) Will is admissible in Probate Court. And, the Will must be signed according to statutory requirements of the state in which it is being signed - the person signing the Will (testator/testatrix) must sign the Will in front of two independent witnesses and a notary, etc. etc. If not, any proposed, "Will" is invalid and non-admissible.

How do I get money from my mother's account if I am the beneficiary?

Answered by attorney Monica H. Donaldson Stewart
Estate Planning lawyer at Donaldson Stewart, P.C.
The answer to your question depends on several factors. For example, are you named as the "pay on death" beneficiary of the account? If not, did your mother leave a Will? Are you the only beneficiary of the estate? If there is no Will, the size of her estate may affect whether you will need to open a probate to collect the account or whether you can do a simplified proceeding. I recommend you speak with a probate attorney to discuss the answers to your questions and determine your options.

Do I have to sign anything at all?

Estate Planning lawyer at Probate Law Center Richard J. Keyes, PC
The house has to go through probate as from your question I assume there is no beneficiary deed. The two of you will have to decide who will be personal representative or you can be co-personal representatives. See an attorney for more details.
