He passed away in California, California law will control. In Texas you would have a problem. Why did you think you were his legal executor if there was no will or probate proceeding appointing you? While people do start collecting the assets of the deceased right away (frequently to pay final expenses), until appointed, you do not have the right to do so. Taking the assets may be theft. You may need to get all of your receipts together to demonstrate where the money went. You will have a problem since you found cash in the hoard. You will not be able to prove the amount you found. Your step siblings may always hold out that it was more than it really was.

The attorney for the estate should tell you what he expects you to do. In Missouri, the personal representative receives a commission based on the value of the property that is actually part of the probate estate. This would only include real property if it was sold. The probate estate normally (in Missouri) does not include any property that the decedent owned jointly with another person (except tenancy in common) and will not include property in trust or life insurance proceeds payable to a named beneficiary (other than the personal representative or the estate). The commission scale is as follows: 5% on the first $5,000 4% on the next $20,000 3% on the next $75,000 2.75% on the next $600,000 2% on everything over $1,000,000.

The answer to your question depends on many facts that are not presented. Chief among them is whether your father is still alive and if so, is he legally competent. If he is legally competent, the answer is always no you cannot take control of his estate. If he is alive but not competent, you will need to go to court to have yourself appointed the conservator of his estate. If he is dead, it depends on whether he left a will or not. If he left a Will, were you nominated to be the executor? Was someone else? If he did not leave a Will, are you his only child? Was he married at the time of death? In all cases, is there any reason why you would not qualify as the person to be in charge?
