Once a will has been made, can the other spouse change it?

Answered by attorney James Bloomfield Oberholtzer
Estate Planning lawyer at James Oberholtzer, Chartered
You are right. Based on what you say, there are several legal problems here. Your mother cannot change the result of your father's Will. Also, your mother may not have had legal capacity at the time she made the changes because of the illness and the drugs. You need to consult with an attorney.

What do I do if I was removed as a beneficiary but was still asked to pay for the mortgage and bills?

Answered by attorney Jessica Robin Barsotti (Unclaimed Profile)
Estate Planning lawyer at Law Office of Barbara A. Goode
I am sorry to hear of your loss. This must be very difficult for you. The lawyer cannot change the beneficiary designation. Did your son have a will or any children? If he had neither, then you may be the beneficiary of the house. If you have paid all the expenses for the last two years you are at least entitled to get that back. It seems that the lawyer is playing games here.

What should I do if my trust that was left to me by my grandfather has been embezzled by two trustees and an attorney I hired?

You can bring suit against the trustees for the embezzlement. This would be done in probate court. The attorney will also have disciplinary charges to deal with if he was involved in the wrongdoing and could face disbarment. I would act on this immediately.
