How long does a lawyer have to notify the heirs of a will details contained within the will?

default-avatar
Answered by attorney Isaac David Shutt (Unclaimed Profile)
Estate Planning lawyer at Shutt Law Firm, PLLC
The executor must give beneficiaries notice within 60 days of the probate of the Will. See Texas Probate Code 128A. However, the executor is not required to give this notice to a beneficiary who is to inherit less than $2,000 in property under the Will. Contact the county clerk in the appropriate county to see if the Will has been admitted to probate. If it has, and you are supposed to inherit $2,000 or more in property, then you should receive the required notice within 60 days.

Do I have any rights to my step dad's estate if I have been taking care of him?

Answered by attorney Dara J. Goldsmith
Estate Planning lawyer at Goldsmith & Guymon, P.C.
It sounds as if you are limited to filing a creditor's claim for the value of the services you provided. The estate can require that you leave. In most states the oral promise is not enforceable, unless you can show detrimental reliance or use other valid theory. I suggest you speak with an attorney about the specifics of the promises, etc. We offer a one hour consultation with an attorney who will provide you with important information regarding your specific case and will able to advise you on the options that you should consider in determining your next steps for the small investment of $100. This is a significant discount from our billing rates. If the issues presented involve reviewing documents and preparation in advance of the meeting, we charge $300 for a premier consultation, because there is over one hour of review and preparation for the meeting and one hour for the meeting.

Do I have to leave each child something when I do my estate planning?

default-avatar
Answered by attorney Norman Harry Green (Unclaimed Profile)
Estate Planning lawyer at Irsfeld, Irsfeld & Younger LLP
No, you do not need to leave anything to any of your children. However, you must mention them in your will. Therefore, for example, "I have four children, namely A, B, C, and D. I give my entire estate to E and F." If you want, you could even throw in, "I give nothing to my issue." Don't put in your reasons.
