Will I be responsible for his debts when he passes away?

Answered by attorney Brian Chew
Estate Planning lawyer at OC Wills and Trust Attorneys
No one is responsible for anyone else debts when someone dies. However any assets in which the person who died own is subject to claims by any creditors to the estate. The fact that someone is charge of an asset (ie an executor of an estate) does not make them the owner of the assets of the estate and thus not subject to the executor's creditors.

If the power of attorney expires when my father passed away, who is to sign the quick claim deed to transfer my father’s home ownership and title?

Answered by attorney Mark T. Peters (Unclaimed Profile)
Estate Planning lawyer at Peters Law, PLLC
His personal representative would have to sign a personal representative's deed. If there is a will, the person nominated in the will should take the will to court and start a probate case. If there is no will, then his wife, children, parents, or creditors may petition the court to start a probate case.

What does it mean in a trust " to be responsible for maintenance"

Answered by attorney Terry Lynn Garrett
Estate Planning lawyer at The Garrett Law Firm, PLLC
There is a difference between maintenance and repair.  You and the remainder beneficiary may look at the damage to the roof differently.  If you absolutely do not have funds, it may well be in the interest of the remainder beneficiary to take out a home equity loan to pay for a new roof (assuming that it is not covered by insurance).
