It depends on a few things. Were you on title to the house? Did you buy the house during the marriage? If you have a community property interest in the house, he can't give it away. Also, if it's your homestead, you may still have occupancy rights to the house.

With free will, you generally get what you pay for, often times errors in disposition of your estate. You can get will forms from stationary store, but my experience as a probate attorney, is the form is incorrectly prepared, or the document fails for the lack of legality of the prepared form provisions. Suggest you obtain the services of a probate attorney for the preparation of a will and be prepared to pay for the service; I don't think you would operate on yourself if you need a surgeon.

If your aunt is competent, have her decide and communicate that decision to someone other than the nephew or caretaker. There is no bright line test on which house to sell. I would do my best to have the decision made by someone other than the nephew and caretaker because of the conflict of interest they would have in making the decision.
