What is the status of limitetion to claim your parent estate in the state of georgia

default-avatar
Answered by attorney Jonathan James Wade (Unclaimed Profile)
Estate Planning lawyer at Wade Law Office
Your question does not make sense as asked. Your parents would not have one estate, they would have two separate estates (assuming they are both deceased). If they passed away in or before 2004, their estates should not still be open. The estates should have been administered, and all property distributed, by now.

How long do I have to carry out the terms of a will after the death?

Answered by attorney David Goldman
Estate Planning lawyer at Law Office of David M. Goldman PLLC
If you have a will, you are suppose to file it with the court within 10 days of death. Once a probate is opened there are time requirements for taking action or seeing permission to get an extension, but there is no requirement to open a probate. Often people wait for 2 years so that if no one files a claim, the claims can be invalidated.

I want to amend my Trust in case I outlive my beneficiary to my trust. How do I find correct language for state of Georgia and do myself

Answered by attorney Loraine M. DiSalvo
Estate Planning lawyer at Morgan & DiSalvo, P.C.
Assuming it was drafted even half-decently, your trust should state in it what you need to do to amend it. And yes, legally speaking, as long as you follow the requirements you can amend your trust yourself. But doing so is likely a very, very, very, very, very, very bad idea. Please do your desired beneficiaries a huge favor, find a good, experienced, estate planning attorney, and have the attorney help you make any changes that are needed or desired. It is so easy to overlook or mess up important details if you don't know what you're doing. Best wishes to you.
