How long does a lawyer have to notify the heirs of a will details contained within the will?

Eric James Smith
Answered by attorney Eric James Smith (Unclaimed Profile)
Estate Planning lawyer at Law Office of Eric J. Smith
There is no requirement that a will be probated. A person named executor in a will must probate the will to act in that role, and then they must qualify to be executor. If you think there is a will and you think you should receive under it, contact an attorney. The probate process relies on interested parties to act.

What does it mean to go through probate?

Answered by attorney Brian Haggerty (Unclaimed Profile)
Estate Planning lawyer at Minor, Bandonis & Haggerty P.C.
You may not need to go through probate. Contact a lawyer and see if your uncle's estate can be resolved without probate. If probate is needed, you should hire a lawyer, although you do not need to.

Am I responsible for the bills that belonged to my deceased mother?

default-avatar
Answered by attorney Darin Christensen (Unclaimed Profile)
Estate Planning lawyer at Bullivant Houser Bailey PC
Her children are not directly responsible for your mother's debts. To the extent that you received assets as a result of her passing, creditors might be able to force you to pay. Even though you have no direct liability, in some cases the creditors will try to convince you to pay; don't without consulting first with a probate lawyer.
