I am sorry to hear about the death of your parents. If your father died without a will, your mother would only get her statutory share which depends on how many children he had and if she was the natural mother of at least one of them. She would not receive 100% unless the children disclaimed their share. Upon her death, if she died without a will, your brother would still be able to inherit.

The preferred method is to set up a trust, and transfer your home to the trust.  Transfer on death deeds are brand new for 2016 in California, and title companies are not insuring them right away after passing.  There's also a very good chance that you will leave your estate without a valid beneficiary, which would put you back in probate.  I suggest going to an attorney.

The answer to your question is determined by the provisions of the durable Power of Attorney held by your father; the DPA could say that your are next in line if your father declines significantly. Read the document carefully and see if you are named as the alternate holder of the DPA for your mom.
