Is there any legal way while his sister is still alive for my husband to gain full ownership if she can’t afford to pay for anything towards the home?

Answered by attorney James P Frederick (Unclaimed Profile)
Estate Planning lawyer at Frederick & Frederick Attorneys at Law
It all depends on how they hold title. If it is as tenants in common, then his sister's share would pass through her estate. If it is held as joint tenants with rights of survivorship, then the last person standing would be the owner.

Does federal court recognize a power of attorney?

Yes, federal courts recognize established powers of attorney. In your stepmother's case, her daughter only has the power granted by the court to serve as trustee of the trust. Only your stepmother could grant power of attorney. If you feel that she is competent to manage her financial affairs, you could petition the court to rehear the matter and make arrangements to get her to court for the hearing.

Can my brother who is the executor of our father's estate, throw me out of the house?

Answered by attorney Christine James
Estate Planning lawyer at James Law Group
Unfortunately you have no legal right to stay. You could make him evict you however which will buy you more time. It would be a shame if it came to that and would be ideal if he would advance you money from the probate. My recommendation would be you find a permanent place to live - a motel is expensive and only temporary which is usually not the best choice.
