What can we do if our lawyer is telling us to waive our mother rights to our late brother's estate or get another lawyer?

Your question is incoherent. What are mother rights? Maybe he means you should waive your own rights? What's so bad about getting another lawyer?

Can I just go in and remove my father's belongings

Answered by attorney Terry Lynn Garrett
Estate Planning lawyer at The Garrett Law Firm, PLLC
You do not write whether the Will has been submitted for probate and you have been appointed executor.  The court-appointed executor has authority over the deceased's belongings.

You can do this by setting up a trust for her benefit that passes to your child at her death. Talk to an estate planning attorney.
