This is a complex question because it can happen. Does the surviving spouse have any rights. Possibly. She may have a dower interest in any real estate owned by the husband she did not sign off on which was transferred to the trust or corporation during their marriage. A spouse may also be entitled to any 401(k) funds from a pension unless the spouse signed off on a transfer or change of beneficiary. Under Michigan law you have a spousal allowance, an exempt property allowance and a homestead allowance for all property required to be probated.

The probate court has information available about your duties. You should contact one of the representatives at the court that appointed you and ask them for an instruction sheet. If they don't have one available they should be able to direct you how to get the information you need.

If you are not a blood relative of this person, and his family is now coming to assert ownership of his property and belongings, you cannot legally change the locks of his home. Even without a will, a person's belongings pass by a law known as intestate succession, so the relatives coming out of the woodwork have a legal claim to the residence as well as any other items of value he left behind. They can assert this claim by filing a small estate affidavit in the county where your friend died.
