In Texas, an interested person can petition the appropriate probate court to compel a person in possession of a Will to deposit the document with the County Clerk. The costs associated with doing so will vary by attorney, but the amount of time involved to achieve this is not substantial. Of course, having the Will deposited only brings it to light. If, as you suspect, there are reasons to believe that the document is not genuine or does not reflect the true intentions of the decedent, you can expect quite a fight. Probate litigation, like anything else, can become very expensive very quickly. Many attorneys handle matters like this on an hourly rate basis, while others may take the case on a contingency arrangement. Visit with a probate attorney near you now, as the issue will not resolve itself in your favor.

In Texas, property paid for before marriage usually does not become community property. The issue is that Texas homestead rights are separate from community ownership interest. A spouse has rights superior to a creditor by virtue of residing in property that the spouse does not own. The title insurance company should be able to provide a document that says he does not have homestead rights without stating that he has an ownership interest in the property. If not, you may consider shopping for a new title company.

The attorney for the estate should tell you what he expects you to do. In Missouri, the personal representative receives a commission based on the value of the property that is actually part of the probate estate. This would only include real property if it was sold. The probate estate normally (in Missouri) does not include any property that the decedent owned jointly with another person (except tenancy in common) and will not include property in trust or life insurance proceeds payable to a named beneficiary (other than the personal representative or the estate). The commission scale is as follows: 5% on the first $5,000 4% on the next $20,000 3% on the next $75,000 2.75% on the next $600,000 2% on everything over $1,000,000.
