Is a son entitled to see his father's will even if the son is not a beneficiary?

Answered by attorney Robert James Slotkin (Unclaimed Profile)
Estate Planning lawyer at Robert J. Slotkin
Until the father is dead, the answer is NO. But after he dies, whoever is holding the will is required to send the will to the clerk of the court in the County where he resided. At that point, it is a public record and you can see it by visiting the clerks' office during business hours.

I am very sorry about your loss.  A tax attorney is not the right type of attorney to assist with your question.  You need to work with an estate planning/probate attorney to get the title/deed updated.

It has been 2 years since my GM died and the trustee (her attorney) has still not settled the trust. no debts, tax filed, is this legal?

Answered by attorney Terry Lynn Garrett
Estate Planning lawyer at The Garrett Law Firm, PLLC
You may want to request that accounting, if only as a prompt, and, if it is not timely provided, ask the court to replace the trustee. A Florida trust lawyer can advise you on whether Florida trust law or the language of this particular trust requires that final distributions be made by a certain date.
