Could I be arrested for DUI if I was sleeping in my car? How?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
DUI/DWI lawyer at Richard B. Jacobson Associates, LLC
You may very well have a defense. IF the car was not running, then you were not driving. You might have said something too much to the arresting officer, of course, and he may have had some kind of tip-off in advance. What you should do is consult a lawyer experienced in DUI defense very soon. Good Luck.

Is it legal to be arrested in the passenger seat of someone else’s car for DUI?

Answered by attorney Jason William Savela
DUI/DWI lawyer at The Savela Law Firm, P.C.
That could be a good case. It depends on the evidence connecting you and your friends car to the minor accident. Time and distance plus whether a witness can put you there etc. If there is evidence to connect the car (or passengers of the car) driving away from scene of accident to accident, then likely can pull over and investigate, including arrest.
