I am representing myself in court for a DUI and the last i herd the the court had lost my drug test what should I say to the court?

Of course they do not need a test to go to trial on a DUI/DWAI case. You can object to "destruction of evidence" but it is pretty technical argument and you really need a lawyer. If you qualify - have the public defender represent you. if you don't, find a knowledgeabel DUI lawyer to take on that issue for you. It will be worth the money you spend, I suspect. Having a med card won't help with the DUI, nor open container.

In Colorado, probably not. To be sure, I would take a copy of your record to a local DUI attorney for a consultation. There would be a charge (probably minimal) for the consultation to see if you are eligible for any type of expungment or sealing of your record.

It depends upon how you define "trouble". A DUI conviction is punishable by up to a year in jail and a $5,000.00 fine. Mandatory minimum penalty of a 1st time DUI with a BAC over .15 is as follows: 2 days in jail, minimum fine of roughly $1600.00; one year revocation of license; ignition interlock for one year (after your license has been reissued; SR22 high risk insurance; alcohol/drug treatment per the court.
