In California, DUIs remain on your DMV record for 10 years and cannot be expunged from your DMV record. The DUI convictions may be expunged from the court records, at the discretion of a judge, but can still be used as enhancements for future DUI filings and convictions. With regards to price, there is no universal price guidelines. Every attorney usually charges differently. I suggest that you contact a number of attorneys in your area to see what the going rate is.

If you are relating that you had a blood alcohol level of .21 you may have had a few beers earlier in the week but apparently you continued drinking. That level is significantly higher than any tolerated blood alcohol level allowed and therefore I believe you will be prosecuted. Engage an attorney.
