Can I file a post conviction relief on charges of driving while ability impaired after sentencing?

David B Harrison
Answered by attorney David B Harrison (Unclaimed Profile)
DUI/DWI lawyer at Miller & Harrison, LLC
While it is legally possible to file for relief (I assume you mean to withdraw the plea and start again), it is extremely unlikely that it would be successful.  The courts look at the advisement you were given in court by the Judge when you entered your plea - not the facts of the case. The issue in withdrawing a plea is whether you understood what you were doing at the time you entered the plea. It will be quite expensive and difficult to try to re-open the case and certainly no guarantee that if you get to re-open the case and start again, that it will turn out better than a deferred sentence (which, if successfully completed, results in dismissal of the charge).

How much does it normally cost to defend a DUI?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
DUI/DWI lawyer at Richard B. Jacobson Associates, LLC
How long is a book? How high is the sky? It depends on the facts of the case, the client's prior convictions, if any. In this area, lawyers usually ask for an advance payment of $1500 to $3,000 for a first or second OWI. The fees are generally higher for subsequent charges.

Answered by attorney Francis John Cowhig (Unclaimed Profile)
DUI/DWI lawyer at Francis John Cowhig
I am assuming that this is your first DUI. Usually there is a 4 to 6 months license suspension, but you may be eligible for a restricted license (to and from school and/or work). If your blood alcohol level is above .20 then there is a 10 month restriction, as well as other enhancements for excessive alcohol. There can also be enhancements for blood alcohol levels above .15 depending on the court and jurisdiction Fines from $390 to $1,000 plus penalty assessments and court costs which beings to the total to about $2,000.00. Your car may be impounded for up to 6 months. Up to 3 year optional ignition interlock device installed on your car. 96 hours to 6 months jail sentence, at least 48 hours of which must be continuance. However, the fact that you were involved in a crash may add additional jail time to the sentence.
