Should I have gotten a DUI instead of DWI because I had no alcohol in my system?

Answered by attorney Shannon Willis Locke
DUI/DWI lawyer at The Locke Law Group
There is a common misconception that Driving Under the Influence is different than Driving While Intoxicated. In fact, in Texas there is no difference. The State may prove loss of normal use of mental or physical faculties by introduction of alcohol or drugs into a person's body. The case that is filed is no different and it does not matter if you ingested drugs or alcohol.

I have a scheduled court date for this week for a class B misdemeanor, on the same day my job is requiring me to go out of town?

Answered by attorney Tristan Nicolas Legrande
DUI/DWI lawyer at LeGrande Law
You can call the court and see if they will permit you to re-schedule it (unlikely, but you can try). Having work is not an excuse the Judge will usually accept to miss a court appearance. If you have hired an attorney, you can check with your attorney of record to see if your specific court will permit you to waive your appearance. If it is the first appearance since being charged (the arraignment) it cannot typically be waived.

What happens when I violated my parole?

Answered by attorney Mark R. Thiessen
DUI/DWI lawyer at Thiessen Law Firm
Hopefully she buys your excuse, but if they try and revoke your parole, you need to hire a parole attorney and fight going back to prison.
