It could be. Sometimes it takes a really long time to get a blood test done because the police need to get a signed search warrant for blood if the person arrested will not consent to the test. She may have had to wait for so many hours that the cop felt sorry for her and because he knew that by the time he returned to the police station she would just be processed for release anyway or he may have had to go to another accident or crime scene (currently many police departments are short handed) so he just took her home on the way.

If they have open alcohol in the car and you are the driver you can be charged with the criminal offense of transporting open intoxicants. It would not matter who owns the car of who it is registered to, you are the driver and you responsible under the law for what is going on in the vehicle you are operating.

I would not anticipate an arrest for DUI. The officer did not obtain any information at the scene in order to support the charge, i.e. he did not conduct a field sobriety test, you did not submit to a breath test. If he did issue a DUI citation, I would anticipate that you would be able to have it dismissed swiftly.
