What happens to a first time offender with a DUI?

Answered by attorney Lawrence Lewis (Unclaimed Profile)
DUI/DWI lawyer at Lawrence Lewis, P.C.
You should plead NOT GUILTY, and locate a good attorney. DID you feel when you struck the car, or was it only when someone told you later that you struck the vehicle.

What can I do if a cop cited me for possession but said he had no reason to pull me over?

Answered by attorney Laurie A. Schmidt
DUI/DWI lawyer at 5280 Law Group
You may have a valid suppression motion, it would depend what the facts are from the cops point of view. Cops cannot just pull you over for no reason, that is a violation of your fourth amendment rights. However, if you pulled over voluntarily, the officer can approach the car for a consensual contact. These cases are very fact specific and turn on the smallest of details. If your rights were violated, you must file a motion with the court asking the court to suppress all information after the illegal contact, for this you will need an attorney.

Can police manhandle you for refusing a Breathalyzer?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
The police cannot lawfully manhandle you. If you have been lawfully arrested for DUI, you are subject to the implied consent law which requires you to provide a sample of your blood or breath. If you refuse to provide a sample of your blood or breath they will charge you with a refusal. The United States Supreme court has upheld the use of force to withdraw blood when arrested for DUI in a refusal situation. Obviously, being held down and having blood drawn by force could also be construed as being manhandled. You should consult with an attorney in your area, they will be able to shed light on some of the defenses that may be applicable to the facts of your case and the likely outcomes in court.
