You need to fight this charge. You may have to go to trial. If you were arrested on or after March 4 immediately call the DMV to request a hearing. You only have 10 days to make such a request for hearing, you do not include the day you were arrested when counting days. You need to get a private attorney if possible to represent you at the DMV and court, public defenders cannot represent you out of court.

Miranda warnings only apply to incriminating statements, not the validity of the arrest. A Miranda violation will never by itself get a case dismissed, it will only suppress incriminating statements made while in police custody. Police only have to read your Miranda warnings when they wish to interrogate you are ask you incriminating questions, not every time they arrest you. Jared C. Austin, Attorney-at-Law
