Should I go to trial if I am being charged for a DUI when my BAC was .05 but the cop thinks I was stoned at the time?

Answered by attorney Laurie A. Schmidt
DUI/DWI lawyer at 5280 Law Group
You have a Constitutional right to a jury trial, if you do not feel that the State can prove its case against you- go to trial. Be sure and talk about potential adverse consequence at trial such as a higher punishment upon a guilty conviction with your public defender. Once you have weighed the pros and cons and you still believe you have a defense- then go to trial.

How much it would cost to get my DUI expunged?

default-avatar
Answered by attorney Francis John Cowhig (Unclaimed Profile)
DUI/DWI lawyer at Francis John Cowhig
You should know that, in California, DUIs remain on your DMV record for 10 years and cannot be expunged from your DMV record. The DUI convictions may be expunged from the court records, at the discretion of a judge, but can still be used as enhancements for future DUI filings and convictions. As to how much it would costs, there is no set fee schedule for how much an attorney charges for his or her services. All attorneys charge differently depending on their experience, locality, complexity of the case, etc. I suggest that you interview a number of attorneys and retain the one you feel most comfortable with and can afford.

I was recently arrested for DUI three days ago, will I lose my job?

Answered by attorney Shirin Behrooz (Unclaimed Profile)
DUI/DWI lawyer at Law Offices of Shirin Behrooz
You can lose your job. Most employees are on an at-will basis, meaning they don't even need a good reason to fire you, as long as it is not discriminatory and it does not violate the terms of your employment contract.
