Can a DUI be dismissed by DMV if no evidence was found?

Answered by attorney Jason William Savela
DUI/DWI lawyer at The Savela Law Firm, P.C.
DMV and Court are 2 different things. If DMV does not proceed, then you get to keep your license unless you are convicted of DUI or have a conviction that revokes your license. BUT You must appear in Court. The case may be dismissed at that time. If not, you might want to get a lawyer to help.

What should I do of arraignment day for DWI?

Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
DUI/DWI lawyer at Freeborn Law Offices P.S.
Same advice I would give; however, there may be little an attorney can do. For one thing, by refusing the breath test, even if you are found not guilty of the DUI, or it is even dismissed, by the simple fact that you refused the breath test, Department Of Licensing can suspend your license for one year, possibly more. These types of cases are very complex. Yes, get a public defender to help you.

How can I go about creating a law in my state?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
DUI/DWI lawyer at Austin Legal Services, PLC
Petition your state legislator to introduce such a bill. Or, you can start a petition drive to get signatures to get such an initiative on the ballot. The requirements will vary from state to state. It always helps to get support from someone with a lot of money who can help you advertise.
