Your case will not be thrown out because you were not read your rights. An arresting officer does not have to read you your rights. The only time Miranda (the reading of rights) comes into play is if you had made a confession that you were drunk and the prosecutor tried to get your confession into court or trial. Then, the confession would not be admitted, because you were not first read your Miranda rights. In this case, there is no confession by you, and therefore your case will not be dismissed.

If you were cited for driving without a license and failed to appear, you likely have a suspended license now. Failure to appear usually results in the issuance of a bench warrant and a "failure to appear" which then results in both a warrant for your arrest and the suspension of drivers license. You must do something to handle the ticket, it doesn't just go away. A DUI attorney can help you move through this process.
