What if u 30 mins away from completing will u get in trouble

David B Harrison
Answered by attorney David B Harrison (Unclaimed Profile)
DUI/DWI lawyer at Miller & Harrison, LLC
I beleive the best approach is to contact whatever agency you report your community service work hours to (probably Community Justice Services or your probation officer), ask for additional time to complete the community service BEFORE the time runs out, and have a plan on when the remaining 30 minutes will be done. This MIGHT avoid you being referred back to the Judge.  However, even if you are referred back to the judge - do the remaining 30 minutes BEFORE the court date and have proof of that - the judge will likely accept it.

If the officer didn't see me drive can he arrest me for DUI?

Answered by attorney Philip Daniel Hache
DUI/DWI lawyer at Law Offices of Phil Hache
If there is no driving, then it sounds like a good case to fight with me. You should speak to a DUI attorney about your case in more detail. Sounds like you already did some investigative work on your own, but there is a lot more work to do on cases like this.

If I had blood drawn and the results read .08 alcohol in my system, was I legally intoxicated?

Answered by attorney Stephen Lewis Freeborn (Unclaimed Profile)
DUI/DWI lawyer at Freeborn Law Offices P.S.
Yes, you were intoxicated. The statute reads ".08 or above", not "above .08". In addition, you could be under a .08 and still be charged if your "operation of the vehicle was affected to an appreciable degree due to the consumption of alcohol and or drugs". Yes, the arrest was proper and state has a case.
