What will happen with first offense marijuana DUI 23152(a) vc?

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. You are looking at substantial penalties and possible jail time. I strongly suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your case. He/she would then be in a better position to analyze your case and advise you of your options.

You will need an attorney, and hopefully you will be able to minimize the damage which you caused yourself. You are facing driver responsibility costs, fines, potential jail time and suspension or revocation of your driving privileges.

Is it legal for them to have me draw blood?

Answered by attorney Jason William Savela
DUI/DWI lawyer at The Savela Law Firm, P.C.
The good news is that the first blood draw probably is not valid due to blood in the mouth. This means that we should be able to win the DMV hearing and you would not lose your license. If a judge approved a warrant, they can draw blood again. But, there may be an issue with the signing. If so, this may keep out the blood results.
