I can only tell you the maximum for a misdemeanor evading is 1 year in jail and/or a fine of$1,000 plus penalties which could be another $,2400. It all depends on the facts. Do not discuss facts over the internet.

There is more to this story, but you have chosen to leave it out. You and your wife both arrive. The police officer does not see you drive, and you or your wife do not admit that you were driving. How did the officer determine that you were driving? Second, why would your license be suspended without an arrest UNLESS you were under conditions not to drink at all. You have had two hearings, and lost both. Let me suggest, without knowing anything more, that you stop drinking altogether. You and drinking do not go together.

You were foolish to refuse the breath test. Under the implied consent law, by refusing the breath test, your license WILL be revoked by Department of Licensing for a minimum of one year, even if you are not convicted of the DUI. The fact that you refused the DUI can also be used as evidence against you in court. At this point, I would tell you to stop messing around and get your self an attorney before you wreck your case even further.
