The penalty for driving while your license is suspended for OUI offense is 60 days in jail, without exceptions. I STRONGLY suggest you get a good lawyer who practices in the court where you are charged with the operating after charge. I have certainly won quite a few of these cases, but they are very difficult to overcome. The statute is tight and specific and allows no alternatives to 60 days committed.

In your case you were not given this paperwork, you need to contact the arresting agency and determine whether this was an oversight or whether the county prosecutor sends notices when charges are filed or some other procedure for notifying you of the case. You may choose to contact a DUI lawyer in your area, frequently they know the procedures used in your particular jurisdiction.

If you are under 21 the consequences are significant, if you are over 21 then you can be charged with, and prosecuted for, driving under the influence but NOT driving with a blood alcohol concentration of .08 or above. A case like this is winnable, you should call a DUI defense attorney within 10 days of your arrest, they should be able to tell you how to best proceed to avoid a DUI and possibly and criminal conviction.
