It is legal. He is in custody at the hospital. You have no more rights to visit him in the hospital, than you have to visit him at the jail.

Would I possibly be able to at least get a permit to get to work so I do not want lose my job and my home?

Even though the arresting officer is no longer on the force, he can still be subpoenaed to testify against you.
