It is a possibility, but from what you wrote I would say the chances are slim. Child Services would have to be called and there must be some proof that your DUI in some way endangered your child.

How can I get my license back after a DUI charge?

Edward D Flint

You have only 10 days to file a written request for a drivers license hearing after a DUI arrest, or you will have your license suspended on the 30th day after the arrest. Your DUI citation is your temporary license, but if you don't act quickly, you will be automatically suspended before your DUI case ever gets to court.
