Can discrepancies between video of field sobriety test and police report be enough grounds for dismissal?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
You need to discuss this with a DUI lawyer. Often the discrepancies between a video and police report can cause a Judge or Jury to look skeptically at other statements made by the officer, if it is in a pre-trial context a motion can be run that may lead the Judge to dismiss the case, or prohibit the prosecution from using some or all of the evidence against you.

I wasn't seen driving but was charge with DUI. Can I claim that I wasn't driving?

Answered by attorney Lawrence Thomas Lewis (Unclaimed Profile)
DUI/DWI lawyer at Lawrence Lewis, P.C.
You can claim whatever you want at trial. IF you testify before a jury, and lose and the judge thinks that you lied, you will be incarcerated for a longer period of time. So, the question is are you a gambler.

What will happen if no one remember who's driving in a DUI accident?

Answered by attorney Laurie A. Schmidt
DUI/DWI lawyer at 5280 Law Group
In any DUI case - the government must prove beyond a reasonable doubt that someone drove. If the government cannot prove who drove beyond a reasonable doubt, than neither your friend or you should be charged with DUI. If either of you is charged with a DUI, I would contact a local DUI attorney to represent you in this case.
