I recently received a DUI on the 17th of this month, am I required to notify the DMV of it?

Mark Corwin Bruce
Answered by attorney Mark Corwin Bruce (Unclaimed Profile)
DUI/DWI lawyer at Law Office M. C. Bruce
Yes, if you don't want your license suspended immediately. You have to call the DMV driver's safety office within 10 days of the arrest-today is the 24th, so that leaves tomorrow or Tuesday (Monday is a holiday). The number is in the upper right hand corner of one of the pink papers the officer handed you. You will be calling to set up a hearing for your license suspension. No, a public defender will not help you with that hearing. Either do it yourself or find the money to hire a lawyer. Most people think they can't afford a lawyer till they call.

How long does it take to officially dispose a DWI case?

Jared Clayton Austin
Answered by attorney Jared Clayton Austin (Unclaimed Profile)
DUI/DWI lawyer at Austin Legal Services, PLC
I'm confused by your question. You shouldn't be having any court dates unless they have filed charges. Why else would you be there? The statute of limitations is the amount of time they have to file charges against you. Each jurisdictions has its own rules about time periods for disposing of cases but for most misdemeanors, it's six months from the time it started unless there is good reason for the delay.

Is it legal for someone with DUI to possess marijuana with a medicinal card?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)
DUI/DWI lawyer at Nelson & Lawless
If you are found guilty of any crime while on probation, then you are violated and could face new charges and time. CA has an actual official medical marijuana card issued upon doctor's certification of medical need. Local dispensaries will sell you a card, which is not CA official, but both are frequently accepted by local police to avoid an arrest for small possession. Neither is honored by the feds. It is a Politically Correct fiction in California only, not binding upon federal law enforcement or courts. Make your own decision whether to obtain a medical card or have marijuana in your possession while on probation.
