Will my someone who is underage get a DUI even if they blow under a .08?

Michael J Nichols
Answered by attorney Michael J Nichols (Unclaimed Profile)
DUI/DWI lawyer at Nichols Law Firm PLLC
This can be a sufficient breath estimate to support a charge known as "zero tolerance." In Michigan, .02 to .08 is defined as zero tolerance or "baby DUI." The short term penalties are significantly less but on the other hand, it is still a lifetime conviction in Michigan.

The accident happened one month ago but a charge was not file yet. Does this usually take long?

Funny. Everything takes a long time when folks are waiting for charges, then moves super fast when it is time to retain an attorney, because money is short. Put your money together now, because charges are coming.

What will happen if no one remember who's driving in a DUI accident?

If they both received tickets, then both were cited. In California the citation should have the court date and location. It will be up to the courts to figure out the answers.
