In SC, if you are referring to refusal to submit to breath and/or bodily fluid testing and the charge is plain DUI, then yes, the State can allege that you refused to submit to testing under certain conditions. These conditions are very highly contested in the legal arena right now and there are technical arguments in regards to a lot of them right now. You should consult in person with an attorney as soon as possible regarding these matters. I do hereby clearly advise against any reliance on the information as advice or application of it to a specific situation without a more thorough consultation with counsel.

There is no Yes/No answer. It depends on the law of the state that has the open warrant. Usually, that charge is a misdemeanor or less and the state issuing the warrant is responsible for the cost of transportation; most states will not pay the cost of transportation for such a minor charge. Be aware that if he is arrested for any charge and the arresting state runs a computer check and sees an open warrant, the arresting state can hold him for a period of time to give the state issuing the warrant an opportunity to come and get him. Usually, the maximum hold is 30 days.

In California, if you are under 21 years old, the legal limit is .01 (extremely low). Anything over that and you can be charged under vc 23136 or 23140. Amongst other penalties can be looking at a 1 year driver license suspension even on a first. You can also still be charged for a dui under vc 23152(a) which does not require a .08 bac (unlike 23152b).
