If your friend got a DUI in your car, can your car get inpounded?

Answered by attorney Harley Ives Gutin
DUI/DWI lawyer at Gutin Wolverton
That can happen. Typically on a DUI plea or conviction the Court orders that the car the defendant was driving be impounded for ten days as that is required under the law. Most judges will either waive that requirement or allow another car to be impounded. Impounded means not used for ten days. The impoundment of the car can be a company comes out and puts a lock on the car. If the car was impounded (literally) during the arrest then there could be other issues such as drugs found in the car or some other reason the car was impounded.

Will the state where he has a warrant pick him up for a DUI charges if his case in another state is still open?

default-avatar
Answered by attorney Robert E McCall (Unclaimed Profile)
DUI/DWI lawyer at Law Office of Robert E. McCall
There is no Yes/No answer. It depends on the law of the state that has the open warrant. Usually, that charge is a misdemeanor or less and the state issuing the warrant is responsible for the cost of transportation; most states will not pay the cost of transportation for such a minor charge. Be aware that if he is arrested for any charge and the arresting state runs a computer check and sees an open warrant, the arresting state can hold him for a period of time to give the state issuing the warrant an opportunity to come and get him. Usually, the maximum hold is 30 days.

Am I looking at mandatory jail time on first dui with hitand run

Russell Thomas Kirshy
Answered by attorney Russell Thomas Kirshy (Unclaimed Profile)
DUI/DWI lawyer at Russell T. Kirshy Attorney at Law
It sounds like you have been arrested for two misdemeanor offenses.  While I don't believe there is any mandatory jail sentence required for these offenses, you should really speak to an experienced criminal defense attorney as soon as possible.  Some counties may want jail time due to the hit and run.  If this occurred in Lee, Hendry, Charlotte, Desoto, Sarasota or Manatee counties, you can call my office and I will be happy to discuss it with you.
