Does anyone have to comply with probation terms before actually being sentenced and placed on probation?

Answered by attorney Philip Daniel Hache
DUI/DWI lawyer at Law Offices of Phil Hache
Sometimes there are specific terms that a Judge will place on someone as a condition of continued Own Recognizance release. For example, they were going to remand you into custody, but your attorney convinced the court to keep you out of jail while the case is pending, but you need to attend 2 AA meetings, or something of that nature. If you violate the court order to do the AA's in that example, there could be consequences from the Judge (ie. remanding you into custody and making you post bail or remain in custody while the case is pending), but it would not be a probation violation since you would not be on probation at that time.

Is it possible to test negative on a breathalyzer and then still have alcohol in your blood?

Most probably not, although the breathalyzer machines periodically fail and the blood tests are more reliable.

You will be arrested. You will be extradited back to GA as soon as officer recognizes that you have a warrant.
