Will a judge show leniency if the DUI charges are 6 and 1/2 years apart?

Answered by attorney Steven M Dodge (Unclaimed Profile)
DUI/DWI lawyer at The Law Office of Steven M. Dodge, PLLC
Without knowing who your judge is, it is impossible for me to answer this question. Sometimes a judge will demonstrate some leniency on these facts but not in all cases.

Will I still need an exemption to work in a nursing home with seniors with an expunged DUI conviction?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)
DUI/DWI lawyer at Nelson & Lawless
Expungement has no effect on your record when applying for any government licensed position. Expungement does NOT clear, 'remove', erase or disappear the conviction. Nothing will. Records are forever. Expungement does change the record to show an arrest, charges filed, with 'conviction reversed and charges dismissed by expungement'. The conviction is still a 'prior' or 'strike' for purposes of repeat offenses. You must disclose the arrest and conviction in any questionnaire or application for certification or licensing by any government agency [medical, legal, educational, professional, law enforcement, security clearances, bonding, etc]. The licensing agency and prospective employer then will decide whether the nature of the past convictions and your record will bar you from licensing and employment in that field.

How long should my license be suspended for a refusal to blow (breathalyzer)?

In New Jersey a breathalyzer refusal with 2 prior DUI's would result in a 10 year license suspension.
