Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. A BAC of .06 is below the legal limit for a DUI (which is .08 or above). Where did you get the Xanax and did you have a prescription for it. I would suggest that you contact an experienced criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your case. He/she would then be in a better position to analyze your case and advise you of your options.

He should ask his attorney, some jurisdictions do not permit sentences to be completed on electronic home detention. An attorney in the jurisdiction where his sentence was imposed should know the requirements for alternative sentencing, most counties have alternatives to county jail depending on the crime and the duration of the sentence.
