If you blow a 1.0, didn't completely fail the sobriety test, but when blood was taken it was lower then 0.08, can or should it be thrown out?

You cannot blow a 1.0, because that would mean that your blood was totally alcohol. IF you blew a .10, then you have a problem.

Shouldn’t I have the right to see the police report before my court date if I got pulled over for a DUI?

You go to the police station and request a police report. It will not contain much more info than the arrest. Your attorney should know exactly how to get a police report.

The best thing to do is to wait, obviously your lawyer is fighting your case and may eventually get it dismissed. Unless the case is dismissed you will either plead guilty/no contest to the charges (or, a lesser charge), or go to trial. If your license was never revoked your lawyer did a good job defending your license at the DMV. These questions are best asked of your lawyer, he/she will likely know the best answers for you and your case.
