That's a violation of her probation. There will be a hearing and the judge can revoke her probation and convict her for the original offense. The other charge will be reinstated if she failed to complete the program.

First, you HAVE to call the DMV within 10 days and schedule a hearing. If you don't, when the test comes back negative it will be too late and you will have lost your license. Second, show up on the arraignment date. The DA will not file and your life will go on as though nothing happened. You can then consider making a complaint against the cop, suing him for false arrest and moving to have the arrest sealed/destroyed.

Your husband was quite mistaken about his rights, since using the roads in Wisconsin creates an 'implied consent' to the police giving you various tests. Your lawyer might be able to suppress the evidence based on a lack of 'reasonable suspicion' by the arresting officer. It's iffy, but it may be worth a try.
