Police have up to 1 year to charge you with a misdemeanor. If he was going to give you a ticket for DUI, he would have done it on the spot, so I think you have nothing to worry about.

Without knowing more about the case, it's hard to say. Your girlfriend could be charged with DUI based on what you said, but that's up to the prosecutor. If she has been charged with a DUI then it could go to trial and could lead to a conviction.
