Does your BAC play a role in DUI sentencing?

Answered by attorney Christopher L Jackson
DUI/DWI lawyer at Law Offices of Christopher L. Jackson, LLC
Yes, your BAC will play a role in sentencing. A higher BAC may result in a greater penalty. Also, in KY if your test is over 0.15 you are charged with an "Aggravated" DUI that carries enhanced penalties. In Ohio, if your test is over 0.17 it is called a "high-tier" and carries enhanced penalties.

What are the consequences for my DUI arrest?

Answered by attorney Cindy Mannon (Unclaimed Profile)
DUI/DWI lawyer at Cindy Mannon, Attorney at Law
I have never heard of being arrested for a DUI and not having to be in court. Ever. After an arrest for a DUI, you are taken to the police station and given a breathalyzer test. You should contact an attorney in the area where the State Park is and see what he/she says. The officer usually gives you a paper license after being arrested. You can't be convicted without going to Court and the ticket will say when you have to appear in Court.

Will my DUI record goes with me if I move to another state?

Answered by attorney Michael B Dungan (Unclaimed Profile)
DUI/DWI lawyer at Dungan, Lady & Dunga, PLLC
Yes, it will follow you everywhere for forever. Not sure how you got a DUI conviction, but no license suspension, you usually can't get one without the other. When you apply to Michigan, they will ask you if you have ever been licensed in another state, convicted of DUI, etc. Tell the truth. They will also run you through several national databases and your Illinois record will show up anyway. Michigan does not care if you are on probation, only if your driver's license is suspended. You will not have a problem getting a license in Michigan with only 1 DUI conviction.
