In California, DUIs remain on your DMV record for 10 years and cannot be expunged from your DMV record. The DUI convictions may be expunged from the court records, at the discretion of a judge, but can still be used as enhancements for future DUI filings and convictions.

Why can be answered by DMV, and you should have asked, but it is because your first DUI in CA was incorrectly punished without them knowing about the out of state prior. You failed to disclose it to them, probably thinking you were skating on it. Had they known of it, you would have been ordered to the 2nd offender program then. You can argue and think what you like now, but will find their order is binding on you. Comply or suffer more unpleasant consequences.
