If the cops believe you were driving the car, they'll probably say they saw you driving it. A video of the incident will be marvelous if you can get your hands on it. Please don't try to handle this without a lawyer. You need one.

The usual answer is yes. As long as there is only a DWI first with no aggravating factors. There will be a fee set by the county and attorney fees. You will need SR-22 compliant insurance and your attorney can explain the requirements of the permit to drive that will be issued.

Sadly, you can't know the answer for sure until your case is either won or lost or ends in an acceptable plea bargain. Since second and subsequent convictions carry jail time (including a minimum period of incarceration) many people think it's worth fighting.
