If cops let you go with no bail on second offense DUI, how you know they filed charges?

Answered by attorney Laurie A. Schmidt
DUI/DWI lawyer at 5280 Law Group
You should check all of your paperwork very carefully. If the officer provided you a citation when you were released from jail -it more than likely include a date to appear and the address of the courthouse. You must appear at that hearing, do not be late. If there was no date, then you should periodically check the local county court (most have websites) for a potential warrant or contact the county court clerk directly to see if a case has been filed. If I blew a .08 and a .07 and got a DUI, can I do something?

You should absolutely get an attorney to assist in your defense, or at least the mitigation of your damages.

How can a person transfer DUI classes to another state without actually transferring the case?

Answered by attorney Laurie A. Schmidt
DUI/DWI lawyer at 5280 Law Group
It is possible to do and this has happened before. The first thing is to approach probation with the transfer if probation ok's it, than she would be able to do the classes in the state and still be on probation in the first state. A very big caveat - most probation terms have travel restrictions. If your client is planning on moving or spending significant time in another state, the court and probation must be informed and proper waivers given.
